These Terms & Conditions (“Terms”) govern your access to and use of the Empire Medical Care website, services, and related digital platforms (collectively, the “Site” and “Services”). By accessing or using the Site or Services, you agree to be bound by these Terms and all policies referenced herein. If you do not agree, do not use the Site or Services.

1. About Empire Medical Care

Empire Medical Care (“Empire,” “we,” “us,” or “our”) operates a telehealth platform that connects eligible users with independent, licensed healthcare providers for virtual urgent care and telehealth services.

Empire Medical Care does not practice medicine and does not interfere with the professional judgment of healthcare providers. Medical services are provided solely by independent providers who are responsible for the care they deliver.

2. Scope of Telehealth Services

Telehealth involves the use of electronic communications to enable healthcare providers to evaluate, diagnose, and treat patients when the provider and patient are not in the same physical location.

You understand and agree that:

  • Telehealth is not a substitute for in-person emergency care

  • Services are limited to non-emergency, mild to moderate conditions

  • Certain conditions require in-person evaluation and cannot be treated via telehealth

  • Providers may determine that telehealth is not appropriate for your situation

If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately.

 

3. No Guarantee of Diagnosis, Treatment, or Prescription

Medical care delivered through telehealth has inherent limitations. You acknowledge that:

  • No specific medical outcome, diagnosis, treatment, or prescription is guaranteed

  • Prescriptions are issued only if clinically appropriate, at the sole discretion of the provider

  • Some medications, including controlled substances, may not be prescribed via telehealth

  • Refill requests are subject to medical review and eligibility

4. Informed Consent for Telehealth

By using the Services, you provide informed consent and acknowledge that:

  • Telehealth may involve the electronic transmission of personal health information

  • Technical issues or data limitations may impact care delivery

  • Lack of physical examination may affect diagnostic accuracy

  • You may withdraw consent to telehealth services at any time

You agree to provide accurate, complete, and current health information, including medications, allergies, and medical history.

5. User Eligibility

The Services are available only to individuals who:

  • Are located in the United States

  • Are legally able to consent to medical services

  • Meet state-specific eligibility requirements

  • Are not accessing the Site for testing, investigative, or legal claim-building purposes

Parents or legal guardians may act on behalf of minors where permitted by law.

 

6. User Accounts & Security

Some Services require account creation. You agree to:

  • Maintain the confidentiality of your login credentials

  • Provide accurate registration information

  • Notify us immediately of unauthorized access

  • Accept responsibility for all activity under your account

Empire Medical Care reserves the right to suspend or terminate accounts at its discretion.

Protected Health Information (PHI) is handled in accordance with applicable laws, provider obligations, and our Privacy Policy and Notice of Privacy Practices (NPP) where applicable.

8. Communications (Email, SMS, Phone)

By providing your contact information, you consent to receive communications related to:

  • Appointment coordination

  • Administrative notices

  • Service updates

You may opt out of non-essential communications where permitted. Message and data rates may apply. Electronic communications may not always be secure.

9. Fees & Payments

Some Services may require payment. By using paid Services, you agree that:

  • Fees are disclosed prior to service delivery

  • Payment authorization is required before services are rendered

  • Insurance coverage is not guaranteed

  • Missed or late cancellations may incur fees

Empire Medical Care does not guarantee reimbursement by insurance providers.

10. Acceptable Use

You agree not to use the Site or Services to:

  • Violate any law or regulation

  • Submit false or misleading information

  • Impersonate others

  • Transmit harmful or malicious content

  • Interfere with Site functionality

  • Harvest user data without consent

We reserve the right to restrict or terminate access for violations.

14. Limitation of Liability

To the fullest extent permitted by law, Empire Medical Care shall not be liable for:

  • Delays or technical failures

  • Loss of data

  • Indirect, incidental, or consequential damages

Your sole remedy for dissatisfaction is to discontinue use of the Services.

15. Indemnification

You agree to indemnify and hold harmless Empire Medical Care, its affiliates, and partners from claims arising out of your violation of these Terms or misuse of the Services.

16. Modifications to Terms

We may update these Terms at any time. Continued use of the Site after changes constitutes acceptance. You are responsible for reviewing the Terms periodically.

17. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of New York and applicable federal law. Any disputes shall be resolved exclusively in courts located within New York, unless otherwise required by law.

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
